I was installing Curse Client 126.96.36.199 today and reading through the License Agreement, when I came across the following portion. Article I, Section 3., paragraph 3 begins:
"By Posting any User Content through or to the Web Site you hereby grant on behalf of yourself or the owner of the User Content if not yourself, to Curse, its successors and assigns a royalty-free, irrevocable, worldwide, non-exclusive, sub licensable, perpetual license to use, reproduce, modify, adapt, translate, publicly perform, publicly display and create derivative works from, transfer, transmit and distribute such User Content (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed."
I'm no lawyer, and may be misinterpreting things, but the way I understand it is that by accepting this License Agreement, you give the rights described above to Curse even if you publish content to www.curse.com via some means other than the Curse Client. In my interpretation this means that if you host a project on www.curseforge.com or wwww.wowace.com and it gets automatically pushed to www.curse.com, you are affected by the above clause, as long as you are also a user of CurseClient. (This is solely my own personal interpretation and should not be considered sound legal advice)
I have had assurance from NeT that this is a copy/paste error and it will be fixed in an upcoming version of the CurseClient. In the meantime however, I would advise addon authors to not install the CurseClient and not accept its License Agreement, until its wording is changed.
Legorol, I'm sure you'd also find that this wording is completely unenforceable as well. No one else can assign those rights except the owner of said content.
However I'll go on the record as follows:
Publicly and officially, I as an agent of Curse, Inc., declare that clause as worded retroactively voided. It was an unintentional oversight, and we apologize. It will, in the next update, either be removed completely or replaced by wording similar to the current Curse.com TOS.
The wording from the current Curse.com TOS section in question:
By submitting, posting or displaying content on, to, or through Curse Websites (or its successors and affiliates), you grant Curse, Inc. a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, display and perform such content on Curse Websites (or its successors and affiliates). Curse, Inc. reserves the right to syndicate User Submissions submitted, posted or displayed by you on or through Curse Websites (or its successors and affiliates) and use that content in connection with any service offered by Curse, Inc. The aforementioned license granted by you terminates once you remove or delete a User Submission from Curse Websites. You also acknowledge that Curse, Inc. may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted. In addition you acknowledge and grant users of the Curse Websites a non-exclusive license to access your User Submissions through the Curse Websites (or its successors and affiliates) and to use such User Submissions as applicable by their respective licenses.
This verbiage was developed by joint effort with several members of the author community, and was deemed to be acceptable and proper by everyone.
Again, we apologize for this oversight and will correct it immediately.
